Why In News?

The Lok Sabha passed the Registration of Births and Deaths (Amendment) Bill, 2026, to implement stricter rules for delayed registrations and strengthen digital governance.

What is the Registration of Births and Deaths Act, 1969?

  • A central law that provides the legal framework for the compulsory registration of births and deaths across India.

  • Establishes the offices of the Registrar General of India, Chief Registrars and Local Registrars, under Ministry of Home Affairs, for maintaining civil registration records.

  • Generates vital statistics used for public health planning, population estimates and policymaking.

Objective

  • Ensure universal, timely and compulsory registration of every birth and death.

  • Provide legal identity through birth registration and accurate mortality records.

  • Create reliable data for governance, welfare delivery, demographic planning and SDG monitoring.

Earlier Reform (2023)

  • Introduced a national and state-level digital database of births and deaths.

  • Enabled electronic registration and digital birth/death certificates.

  • Made the birth certificate a single document for services such as admission to educational institutions, driving licence, voter rolls, Aadhaar, marriage registration, government employment and passport, subject to applicable laws.

  • Required sharing of data by State Registrars with the Registrar General of India to improve interoperability.

What are the Key Provisions of the 2026 Amendment Bill?

Stricter Delayed Registration: Births or deaths reported after two years can be registered only with the approval of a Judicial Magistrate First Class (JMFC), replacing the earlier Executive Magistrate approval.

Improved Data Integrity: Aims to curb fraudulent, fabricated and back-dated registrations, strengthening the authenticity of civil registration records.

Timely Registration: Encourages citizens to register births and deaths within the prescribed timelines to improve the quality and reliability of vital statistics.

Legal Identity & Governance: Reinforces the birth certificate as the foundation of an individual's legal identity and improves service delivery, welfare targeting and population statistics.

Reduced Scope for Misuse: Tightens procedures to prevent misuse of delayed registration for fraudulent claims relating to age, inheritance or identity.

Significance

  • Strengthens Legal Identity: Ensures authentic birth records, which are the foundation for accessing education, healthcare, passports and social welfare.

  • Improves Governance: Enhances the quality of Civil Registration and Vital Statistics (CRVS) data for evidence-based policymaking.

  • Prevents Fraud: Reduces forged birth and death certificates used in identity fraud and illegal claims.

  • Supports Welfare Delivery: Enables better targeting of government schemes through accurate population records.

  • Enhances National Security: Strengthens identity verification and reduces misuse of forged documents.

  • Supports SDG Monitoring: Contributes to SDG Target 16.9 on providing legal identity for all, including birth registration.

Conclusion

The Registration of Births and Deaths (Amendment) Bill, 2026 strengthens India's civil registration system by promoting timely, authentic and tamper-resistant registration, thereby improving legal identity, governance and public service delivery.
